3. The petitioners seek Tribal Incentive Allowance and Additional House Rent Allowance as admissible under the recommendations of 6th and 7th Pay Commissions. This is in view of Government Resolution (G.R.) dated 06/08/2002. It needs to be noted here that the petitioners are working in the Naxalite Area of Zilla Parishad, Yavatmal. The Government provided houses to the employees who are working in the Tribal and Naxalite Area. Where the Government houses are not available for them, such employees are held entitled for the Additional House Rent Allowance as per the Carpet area allotted to them, as per the pay scale. It is the contention of the petitioners that the Zilla Parishad, Yavatmal has denied the said benefit to the employees like petitioners who are working in Tribal and Naxalite Area.
